What if I want out of the lease before the contract expires?
I rented a small studio apartment now. The address is good, but … Now the problems are: noise from neighbors when you close the door and talk out loud, with a roof lights too bright, and often the smoke detector activates when I'm not cooking, not to take a shower and do not smoke … I feel so insecure when I'm home. The smoke detector is connected, I asked for help, but the officer said could not extinguish it does not work with batteries. So I was looking for other apartments better now. Is it reasonable to break the lease, in my case? Is it the owner or real estate agent paid? (Actually, was not allowed to inspect the unit before signing the lease, instead of the agent showed me other similar apt in this building) I am located in Australia (Melbourne), anyone know if it's easy to transfer the lease someone else here? The contract lease is 12 months, ending in January 2009. plx you share your experience with me? Thank you.
I do not know what the rules are in Australia, but I think they are similar to the United States. In general, if you were to break the lease, you will lose any deposit to register. In addition, you may be liable for rent until a new tenant is found or your lease (whichever comes first). There are several reasons why a unit is not shown a tenant possible to reach them is that someone already living in that unit. If the owner says you have to sign a lease before we could see a unit, is a sign for you to walk. Once the lease is signed by you, are legally obliged to comply.
